This privacy notice is intended to provide you with information about the personal information we collect about you and how that information is used and shared in the context of the processing activities undertaken by the Trade Licensing and Control Unit. Information we collect and how we use it
We collect your personal information for a variety of purposes and rely on a number of different legal bases to use this information. In most cases, we rely on your explicit consent to process your personal information. Where we do, you have the right to withdraw your consent at any time. In most circumstances, your consent can be withdrawn by following the unsubscribe instructions included at the end of each e-mail communication from us or you can contact us at: firstname.lastname@example.org and we will be happy to facilitate your request.
If you correspond with us, we will use your contact information to respond to your enquiry. We process this information on the lawful processing ground of consent and in the exercise of official authority vested in us in pursuit of providing services and maintaining relationships with our customers and stakeholders.
- To provide customer service and manage ordinary business needs
We may use your personal information to provide you with customer service and manage ordinary business needs, including for internal purposes such making an enquiry on your behalf. Our lawful basis for this type of use of your personal information is the exercise of our official authority in pursuit of providing services to our customers and stakeholders.
Data storage and retention
We will retain your personal information as needed to fulfil the purposes for which it was collected. We will retain and use your personal information no longer than is necessary.
The default standard retention period for records created, received or held by staff of the Trade Licensing and Control Unit in the course of our duties is current + six years i.e. records are retained while current plus an additional six years from when they become non-current. This applies to all records held by the Trade Licensing and Control Unit with the sole exception of records relating to firearms and, where appropriate and feasible, their parts and essential components and ammunition. Records relating to firearms will be held while the records are current plus an additional twenty years from when they become non-current. This is in accordance with Article 12 of Regulation (EU) No. 258/2012 of 14 March 2012.
We do not transfer your personal data outside the European Economic Area (EEA).
Your data rights
You have several rights under data-protection law in relation to how we use your personal information. You have the right, free of charge, to:
- Request a copy of the personal information we hold about you. You can do this by completing a Subject Access Request (SAR) form.
- Rectify any inaccurate personal information we hold about you.
- Withdraw your consent where we have relied upon your consent to process your information.
- Erase the personal information we hold about you subject to certain exceptions.
- If technically feasible, have your personal information transmitted to another data controller in a machine-readable format at your request.
- Restrict processing of your personal information in certain circumstances.
- Object to our use of your personal information for certain purposes.
- Not be subject to a decision which is based solely on automated processing where that decision produces a legal effect on you or otherwise significantly affects you. We do not make automated decisions of this nature.
Making a complaint
You can Make a complaint with the Data Protection Commission (DPC) if you have concerns about how we process your personal data.
These rights are in some circumstances limited by data-protection legislation. If you wish to exercise any of these rights please contact us at: email@example.com. We may take measures to verify your identify. We will do this by reference to copies of acceptable identification documentation supplied by you.
We will endeavour to respond to your request within a month. If we are unable to deal with your request within a month we may extend this period by a further two months and if this occurs we will contact you and explain why.
Consequences of not providing information
Where we need to collect your personal data and you fail to provide that data when requested, we may not be able to provide you with the information you require for the services we deliver. In this case, we may have to cancel the delivery of these services to you, but we will notify you if this is the case at the time.
We may update this privacy notice from time to time. If we make changes, we will notify you prior to the changes taking effect by posting a notice on our websites and, where appropriate, sending you a notification.
