Notice under Section 8(2)(b) of the Protection of Young Persons (Employment) Act 1996

Section 8(2)(b) of the Protection of Young Persons (Employment) Act 1996 requires the Minister for Business, Enterprise and Innovation to publish a notice indicating her intention to make regulations under the Act.

The proposed Regulations will revoke and replace The Protection of Young Persons (Employment) (Exclusion of Workers in the Fishing and Shipping Sectors) Regulations 2014 (SI No 357 of 2014).  Those Regulations disapplied the exclusions for young people (aged 16-17) in the shipping sector in relation to night time work. The new Regulations will extend the disapplication on night time working for young persons in the fishing sector also. 

Separate provisions in relation to exemptions from night-time-working rules for young persons in the fishing sector, where training programmes are involved, will be contained in Regulations to be made by the Minister for Transport, Tourism and Sport under its transposition of the EU Directive 2017/159/EU on the Agreement concerning the implementation of the Work in Fishing Convention (2007) of the International Labour Organisation.

Under the 1996 Act, Members of the public have 21 days, commencing on the date of publication of this notice, to make representations to the undersigned.
