SI No 616 of 2016 European Union (Collective Rights Management) (Directive 2014/26/EU) (Amendment) Regulations 2016

Minister Mitchell O’Connor signed the European Union (Collective Rights Management) (Directive 2014/26/EU) (Amendment) Regulations 2016 (SI No 616 of 2016). The intention of these Regulations is to make a technical amendment to the European Union (Collective Rights management) (Directive 2014/26/EU) Regulations 2016 (SI No 156 of 2016), which impose governance requirements on collective management organisations established in the state.

These new Regulations make a minor technical amendment to the previous Regulations, which is necessary to avoid a conflict between the duties of a Director to manage a company under the Companies Act 2014 and the requirement under the Regulations for a collective management organisation to establish a supervisory function which does not consist of those persons with the power of management and thus prevents the Board from undertaking the role of the supervisory function.
